OMAĜO operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”). OMAĜO is powered by Shopify, which enables us to provide the Services to you. The terms “we”, “us” and “our” refer to OMAĜO. 

The below terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”) describe your rights and responsibilities when you use the Services. Please read these Terms of Service carefully, as they include important information about your legal rights. By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy [LINK]. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.

 

ARTICLE 1 - ACCESS AND ACCOUNT
  1. To use the Services, including accessing or browsing our online stores or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our stores is correct, current and complete and that you have all rights necessary to provide this information.
  2. You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.
ARTICLE 2 - OUR PRODUCTS
  1. We have made every effort to provide an accurate representation of our products and services in our online stores. However, please note that colours or product appearance may differ from how they may appear on your screen due to the type of device you use to access the store and your device settings and configuration.
  2. We do not warrant that the appearance or quality of any products or services purchased by you will meet your expectations or be the same as depicted or rendered in our online stores. Since all products are handmade, slight variations may occur. If a product does not meet your expectations, you may return it in accordance with Article 6. However, such variations are not grounds for filing a claim.
  3.  Our products are services are in limited quantities and may not always be available.
ARTICLE 3 - ORDERS
  1. You may place an order with OMAĜO through its online system. When you place an order, you are making a binding offer to purchase. Review your order carefully before submitting, as OMAĜO may be unable to accommodate cancellation requests after an order is accepted. In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the e‑mail, billing address, and/or phone number provided at the time the order was made.
  2. Your order will be processed after payment is received. OMAĜO reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until OMAĜO confirms acceptance.
  3. You are responsible for providing accurate information when ordering. We are not liable for delays or non-delivery due to incorrect information provided by you.
  4. You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.
ARTICLE 4 - PRICES AND PAYMENT
  1. Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Prices include VAT but do not include shipping costs.
  2. Shipping costs will be calculated and displayed during checkout.
  3. Payment is due at the time of order placement are and can be made using credit card.
  4. Credit card details are securely and automatically transferred to the payment processor through an encrypted system. Neither OMAĜO nor any third parties have access to this information. Even in the case of a refund, full credit card details remain inaccessible.
ARTICLE 5 - SHIPPING AND DELIVERY
  1. OMAĜO ships orders within the European Union using shipping carriers (DPD). The package may be handed over to a local courier in the destination country. OMAĜO has no influence on which local courier is selected for the final delivery.
  2. Your order will be shipped within 3 business days after receiving your payment. If an article is out of stock, you will be notified immediately. Delivery times vary between 3 to 7 business days, depending on your location. 
  3. OMAĜO is not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers or events outside our control. We are responsible for the product until its delivery to you at the address provided, unless you choose a different carrier than the one we offer or if you give prior permission for delivery to third parties. 
  4. If you were unavailable at the time of delivery or failed to pick up the package from a designated collection point, and the package is returned to OMAĜO, additional shipping costs for resending the package will be charged to you. If you refuse to pay these additional costs, the order will be considered cancelled, and a refund will be initiated, deducting any shipping and handling fees incurred by OMAĜO.
ARTICLE 6 - RIGHT OF WITHDRAWAL
  1. You have the right to withdraw from your order within 14 calendar days from the day you (or a third party designated by you) receive the product, without providing any reason. To exercise your right of withdrawal, you must inform us by email: info@omagoshop.eu
  2. If you withdraw from the order, you must return the products without undue delay and no later than 14 days from the day you communicated your withdrawal decision.
  3. To qualify for return, products must be unused, in original condition and packaging; and must include all accessories, labels, and documentation. The right of withdrawal does not apply to personalised or customised products.
  4. We will refund all payments received from you, including standard delivery costs (but not additional costs if you chose express delivery), within 14 days from the day we receive the returned products or you provide proof of return, whichever is earlier. Refunds will be made using the same payment method you used for the original transaction, unless you expressly agree otherwise. No fees will be charged for the refund.
  5. You are responsible for the return shipping costs. We recommend using tracked shipping for returns.
  6. You are liable for any diminished value of the products resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the products (e.g. handling beyond what would be allowed in a physical store).
ARTICLE 7 - DAMAGE DURING TRANSPORT

Our parcels are packed with the greatest care. Should damage occur during transport, we will replace or refund the damaged item. To address the situation, inform us of the damage by email: info@omagoshop.eu

ARTICLE 8 - WARRANTY AND CONFORMITY
  1. We recommend that you inspect the quality and quantity of the products upon receipt and notify us within a reasonable delay if there are any issues. If products are defective or non-conforming, you may be entitled to repair, replacement, price reduction, or contract termination.
  2. All product descriptions, information and materials shown on this website are provided "as is", without explicit or implicit guarantees, except those established by law. To claim under the warranty, contact us at info@omagoshop.eu with: order number, description of the defect, photos of the defect and proof of purchase.
  3. The warranty does not apply in case of defects caused by improper use, alterations or attempted repairs made by you or a third party, or use of the product in a manner for which it was not intended. As our products are handmade and often possess the characteristics of the natural materials used for their manufacture, variations in colour, texture, size, and finish may occur and are not considered defects but inherent characteristics of artisanal craftsmanship.
  4. If the complaint is justified, we will cover reasonable shipping costs. If not justified, you pay the return costs and any reshipping fees. The item must always be packed securely. We recommend obtaining a shipping receipt, as you are responsible until we receive it.
ARTICLE 9 - INTELLECTUAL PROPERTY
  1. Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by OMAĜO, its affiliates or licensors and are protected by applicable patent, copyright and other intellectual property laws.
  2. These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services without our prior written consent. Except as expressly provided herein, nothing in these Terms grants or shall be construed as granting a license or other rights to you under any patent, trademark, copyright, or other intellectual property of OMAĜO, Shopify or any third party. Unauthorised use of the Services may be a violation of applicable intellectual property laws. All rights not expressly granted herein are reserved by OMAĜO.
  3. OMAĜO’s names, logos, product and service names, designs, and slogans are trademarks of OMAĜO or its affiliates or licensors. You must not use such trademarks without the prior written permission of OMAĜO. Shopify’s name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.

  1. Certain content, products and services available via our Service may include materials from third-parties. Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties.
  2. We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

By using the Services, you acknowledge that you have read these privacy policies.

Occasionally there may be information on or in the Services that contain typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).
  2. Background information, such as historical or geographical, presented on this site is provided for your reference only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.
